Terms of Use

Cognexo Website Terms of Use

Terms of use for visitors to www.cognexo.com

About these Terms

These Terms of Use (“Terms”) govern your use of www.cognexo.com and any related subdomains, together with all content, features and functionality available through them (the “Website”). The Website is operated by Intuitive Learning Limited, trading as Cognexo (“Cognexo”, “we”, “us”, “our”), a company registered in England and Wales with company number 10605207, whose registered office is at Cognexo, Platform, New Station Street, Leeds, West Yorkshire, LS1 4JB, United Kingdom.

The Website is our public marketing and information site. It describes our workforce readiness platform (the “Platform”), shares case studies and thought leadership, and lets visitors book a demonstration, get in touch, or apply for a role with us. The Website does not itself provide access to the Platform.

These Terms are different from, and do not apply to, use of the Platform itself. If your organisation has subscribed to the Platform and you have been registered as an Authorised User, your use of the Platform is instead governed by our separate Platform Terms of Service.

By browsing or otherwise using the Website, you accept these Terms. If you do not agree with them, please stop using the Website.

We may update these Terms from time to time to reflect changes to the Website, our services, or applicable law. We will update the “Last updated” date above when we do. Continuing to use the Website after an update means you accept the revised Terms, so please check back periodically.

Using the Website

The Website is provided for general information about Cognexo and our services, and to let prospective customers, candidates, journalists and other visitors get in touch with us. You may view, browse and print pages from the Website for your own personal or internal business reference.

You must not use the Website in any way that:

  • is unlawful, fraudulent, or intended to harm or defraud any person;

  • attempts to gain unauthorised access to the Website, our servers, or any system or network connected to the Website;

  • introduces viruses, malware or other harmful code, or uses bots, scrapers or other automated means to extract data from the Website, other than standard search engine indexing;

  • interferes with the proper working of the Website or places an unreasonable burden on our infrastructure; or

  • impersonates any person, or misrepresents your affiliation with any person or organisation.

We may restrict or withdraw access to the Website, in whole or in part, at any time, without notice, including to protect its security or availability.

Intellectual property

Unless stated otherwise, the Website and all content on it — including text, graphics, logos, case studies, diagrams and underlying design — is owned by or licensed to Cognexo and is protected by copyright, database rights, trademark rights and other intellectual property laws. “Cognexo”, the Cognexo logo, “Readiness Diagnostic™” and “Readiness Curve™” are trademarks of Cognexo; other names and logos on the Website, including those of our customers and partners, belong to their respective owners and appear with permission or under fair use for identification purposes.

You may not reproduce, republish, distribute, or create derivative works from any part of the Website for commercial purposes without our prior written consent. Nothing on the Website grants you any licence to use our trademarks, or those of any customer or partner featured on it, other than to view them in context.

Enquiries, bookings and applications

Where the Website lets you submit information — for example, by booking a demonstration, completing a contact form, subscribing to updates, or applying for a role via our careers page — you agree to provide accurate and current information, and to use these features only for their intended purpose.

Demonstration bookings are currently handled through Microsoft Bookings, and some pages link out to third-party tools such as ChatGPT or Gemini to let you ask questions about Cognexo; your use of those third-party tools is governed by their own terms, not ours.

Personal data you submit through the Website — such as your name, email address, employer, or CV — is handled in accordance with our Privacy Policy, and, where relevant to job applications, in accordance with UK data protection law including the UK GDPR and the Data Protection Act 2018.

Third-party links and content

The Website may contain links to third-party websites, tools or content, including customer websites, social media, and AI assistants. These links are provided for convenience and do not imply our endorsement of, or responsibility for, that third-party content. We have no control over third-party sites and are not liable for their content, accuracy, or availability. If you follow a link away from the Website, we encourage you to review the terms and privacy practices of the site you land on.

Case studies, statistics and other content

Case studies, statistics, and claims about outcomes achieved with the Platform reflect the specific customer, context and time period described, and are provided for illustrative purposes. They are not a guarantee that any other organisation will achieve the same or similar results. Content on the Website, including blog articles and FAQs, is provided for general information only and does not constitute professional, legal, or business advice; you should not rely on it as a substitute for your own due diligence or professional advice specific to your circumstances.

No warranty and limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under English law.

Subject to that, the Website and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including as to accuracy, completeness, or fitness for a particular purpose. We do not guarantee that the Website will be available at all times or free from errors or interruptions.

To the fullest extent permitted by law, we exclude all liability for any loss or damage arising from your use of, or inability to use, the Website, or from your reliance on any of its content, except where that liability cannot be excluded by law. This section does not affect any separate liability terms agreed under a Customer Agreement or Platform Terms of Service, which govern the Platform itself rather than this Website.

Cookies

We do not use cookies to collect personally identifiable information about you.

Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with them, including non-contractual disputes, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any such dispute, except that we may bring proceedings to protect our intellectual property rights in any competent jurisdiction.

General

  • Entire agreement: these Terms, together with our Privacy Policy, form the entire agreement between you and us about your use of the Website.

  • Severability: if any part of these Terms is found to be unenforceable, the rest will remain in effect.

  • No waiver: if we do not enforce a right under these Terms, that does not mean we have given it up.

  • Assignment: we may transfer our rights and obligations under these Terms to another organisation, for example as part of a reorganisation or sale of our business.

  • Third-party rights: a person who is not a party to these Terms has no right to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.
